1. ABOUT CAR CONNECT TAG

CAR CONNECT TAG is a vehicle-contact solution designed to help a person who needs to communicate with a vehicle owner through the contact mechanism made available through the Tag. Depending on the product configuration and available services, a user may be able to initiate communication through calling, messaging or WhatsApp. Exact features may depend on the product, activation status, technology, network availability and Company Policy.

2. ELIGIBILITY

You must provide accurate information while purchasing or activating the Product. You confirm that you are legally capable of entering into a binding agreement, information provided by you is accurate, you will use the Services only for lawful purposes, and you will not misuse the Tag, website, QR code, platform or communication facility.

3. PRODUCT PURCHASE

CAR CONNECT TAG may be purchased through the Company website or authorised sales channels. Product price, applicable taxes, shipping charges and other applicable charges will be displayed at the time of purchase. The Company may change product pricing prospectively. An order is subject to availability and successful payment.

4. PRODUCT ACTIVATION

A CAR CONNECT TAG may require activation before certain Services become available. The purchaser/vehicle owner is responsible for accurate activation information. The Company may use OTP, email, mobile verification or other authentication mechanisms.

5. TAG OWNERSHIP AND USE

After purchase, the physical Tag belongs to the purchaser subject to applicable payment and transaction terms. The Tag must not be altered, tampered with, duplicated without permission, resold as an unauthorised product, used to impersonate another person, used for unlawful communication, or modified to interfere with Company systems.

6. TAG PLACEMENT

The Tag should be installed according to Company instructions. Recommended placement is on the windshield in the designated visible area, preferably on the passenger/navigator side and without obstructing driver visibility. The Company is not responsible for consequences arising from improper installation or placement.

7. HOW THE SERVICE WORKS

A typical interaction may involve: SCAN → CONNECT → RESOLVE. A person may scan the QR code displayed on the Tag and access available communication options. Availability depends on the Tag configuration and technical systems. Successful communication may also depend on internet connectivity, mobile networks, device compatibility and third-party services.

8. PRIVACY AND NUMBER PROTECTION

CAR CONNECT TAG is designed with privacy considerations, including mechanisms intended to avoid unnecessarily displaying the vehicle owner's personal mobile number on the physical Tag. Where masked calling or another privacy-preserving mechanism is provided, actual availability and operation may depend on underlying technology and service providers. Personal information is governed by the Company's Privacy Policy.

9. USER RESPONSIBILITY

Users must use the Service responsibly. You must not use CAR CONNECT TAG to harass or threaten another person, send abusive or unlawful communications, collect personal information without lawful purpose, impersonate another person, conduct fraud, send spam, facilitate criminal activity, attempt unauthorised access, interfere with QR codes/platform functionality, or violate applicable law.

10. COMMUNICATION BETWEEN USERS

CAR CONNECT TAG facilitates communication between users and vehicle owners. The Company is not a party to personal conversations between users and does not control their content, tone, accuracy or legality. Users are responsible for their own communications and conduct.

11. NO GUARANTEE OF VEHICLE OWNER RESPONSE

The Service facilitates contact; it does not guarantee that the vehicle owner will answer, respond or take any particular action. The Company does not guarantee that the owner will move the vehicle, return to it, resolve a parking issue, respond immediately or take any particular action.

12. EMERGENCIES

CAR CONNECT TAG is not an emergency-response service. It should not be relied upon as a replacement for police, ambulance, fire, roadside assistance or other emergency services. In an emergency, contact the appropriate emergency service directly.

13. NETWORK AND THIRD-PARTY SERVICES

Certain Services may depend on telecommunications networks, internet services, WhatsApp, SMS providers, cloud infrastructure, payment gateways, hosting providers or other third-party services. The Company does not control third-party infrastructure and cannot guarantee uninterrupted availability. Third-party services may have their own terms and policies.

14. WEBSITE CONTENT

The Company makes reasonable efforts to keep website information accurate and current. Product images, descriptions, specifications, features, availability and other information may be updated from time to time. Minor differences between images and physical products may occur due to manufacturing, printing or display conditions.

15. INTELLECTUAL PROPERTY

All intellectual property relating to CAR CONNECT TAG and the website, including trademarks, logos, product designs, graphics, photographs, text, software, QR technology, website design, databases and documentation, belongs to or is lawfully used by VYOM TECH INDIA or its licensors. No intellectual property rights are transferred merely by purchasing or using the Product.

16. WEBSITE USE

You must not attempt unauthorised access, introduce malicious code, interfere with website operation, scrape or copy website content for commercial use, reverse engineer the website/platform, bypass security mechanisms, create fraudulent accounts or use automated systems in a manner that harms the Service.

17. ACCOUNT SECURITY

Where account registration is required, you are responsible for maintaining the confidentiality of login credentials and OTPs. Do not share authentication credentials with unauthorised persons. Inform the Company if you suspect unauthorised access.

18. PAYMENT

Payments may be processed through authorised payment gateways or Company-approved methods. Where payment processing is handled by a third-party provider, the Company does not ordinarily receive or store complete card details. Payment gateway services may have their own terms.

19. SHIPPING AND DELIVERY

Products will be dispatched to the delivery address provided during purchase. Delivery timelines are estimates unless expressly stated otherwise. Delays may occur because of logistics providers, weather, natural events, strikes, regulatory restrictions, incorrect addresses or circumstances beyond reasonable control.

20. RETURNS, REPLACEMENT AND REFUNDS

Returns, replacement and refund eligibility are governed by the Company's applicable Return & Refund Policy displayed on the website. Personalised, activated or used products may be subject to additional conditions where legally permissible. Refunds will be processed through the applicable payment/refund mechanism and policy.

21. DAMAGED OR DEFECTIVE PRODUCT

If the Product is received damaged or defective, contact the Company within the period specified in the Return/Replacement Policy and provide information or evidence reasonably requested. The Company may investigate before approving replacement or another remedy.

22. WARRANTY

Any warranty provided for CAR CONNECT TAG will be governed by the specific warranty terms applicable to the Product. Warranty does not normally cover damage caused by misuse, unauthorised modification, tampering, improper installation, accidental damage or normal wear and tear, subject to applicable law.

23. SUSPENSION OR TERMINATION

The Company may suspend or restrict Services where reasonably necessary due to suspected fraud, misuse, unlawful activity, security concerns, violation of these Terms, payment issues, unauthorised use or technical/operational requirements. Suspension or termination does not affect rights or obligations accrued before such action.

24. DISCLAIMER

To the maximum extent permitted by applicable law, Services are provided on an “as available” basis. The Company does not guarantee uninterrupted or error-free service, availability in every location, compatibility with every device, availability through every network or resolution of every vehicle-related communication situation. Nothing excludes rights or remedies that cannot lawfully be excluded.

25. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, VYOM TECH INDIA shall not be liable for indirect, incidental, consequential or special losses arising from inability to contact a vehicle owner, third-party network failure, connectivity issues, user conduct, misuse of the Tag, incorrect information, delayed communication, failure of the owner to respond, unauthorised use or circumstances beyond reasonable control. Nothing excludes or limits liability that cannot legally be excluded or limited.

26. USER INDEMNITY

To the extent permitted by applicable law, you agree to indemnify and hold harmless VYOM TECH INDIA and its authorised personnel from claims, losses, liabilities or expenses arising from your unlawful use of the Service, fraud, misuse of the Tag, violation of these Terms, infringement of third-party rights or unauthorised conduct.

27. FORCE MAJEURE

The Company is not responsible for delay or failure caused by circumstances beyond reasonable control, including natural disasters, war, civil disturbance, government restrictions, telecommunications failure, internet outages, cyber incidents, strikes, supply disruptions or infrastructure failure.

28. CHANGES TO THESE TERMS

The Company may update these Terms from time to time. Updated Terms may be published on the website with a revised Last Updated date. Continued use after an update may constitute acceptance of revised Terms where legally permissible.

29. PRIVACY POLICY

31. GOVERNING LAW

These Terms shall be governed by the laws of India. Subject to applicable law, courts having jurisdiction at Jaipur, Rajasthan shall have jurisdiction over disputes arising from these Terms.

32. SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions shall continue to the extent permitted by law.

33. NO WAIVER

Failure by the Company to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision later.

34. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Return & Refund Policy, Warranty Policy and other policies expressly incorporated by reference, constitute the applicable agreement governing use of the Website and Services.
